Of course its a borrowing, even a plagiarism - its the same tune
Rick Rubin produced both records
John Frusciante has used similar 'borrowings' before: and at one point he dresses like Tom Petty in the video
 - the question is - is it invalid to do it!

i love the way frusciante rips off "purple haze" in his solo, still its not an altogether awful record
